Marijuana Public Use Under Title 7 In order to create safe public zones for marijuana use, and thereby decrease the number of impaired drivers on the road, Title 7 of the Indiana Code should adopt marijuana usage laws that mirror those currently in place for public tobacco use.185 Under current Indiana law, smoking (tobacco) is prohibited in public spaces (with exceptions), within eight feet of a public entrance or place of enjoyment, a place of employment, or a vehicle owned, leased, or operated by the state if being used for governmental purposes.186 Locations that are currently exempt from the Indiana smoking ban include horse-racing facilities, riverboats, facilities with a gambling license, or other specified businesses that meet stringent requirements.187 Though this list is not extensive, it does allow smokers to use a legal product in select public places in a manner that has been determined acceptable.
